Terms of Sale

 

We are JKL Jewellery (“we”, “our” and/or “us”).

 

These terms and conditions of sale ("Terms of Sale”) apply to the ordering (“Order”) of any of our products (“Product(s)”) by any person other than us (“you” and/or “your”) either from our website www.jkljewellery.co.uk ("Site"), by telephone or via any other form of communication, and where you are ordering from our Site, these Terms of Sale should be read in conjunction with our Terms of Use and our Privacy Policy (both as set out on this Site). We may change these Terms of Sale at any time.

 

How your contract is formed with us

 

When you submit your Order, you are offering to buy the Product(s) at the price set out on our Site or as otherwise quoted by us to you.  We will not be under an obligation to supply the Product(s) until we have sent you a confirmatory email confirming your Order. A contract between us (“Contract”) will only be formed once we have sent you such confirmatory email.

 

Payment

 

The prices indicated on our Site at checkout or as otherwise quoted by us to you include all taxes, including VAT (if any), which may be payable in respect of the Product(s). Please note that additional delivery charges shall apply.

 

Unless otherwise agreed in writing by us, all payments must be made prior to the time of dispatch of the Product(s) to you. We will not dispatch the Product(s) until we receive payment in full. Where we have agreed in writing that payment can be made after dispatch of the Product(s) to you, you shall make payment in cleared funds within 30 days of the date of the relevant invoice.

 

Prices are liable to change at any time, but changes will not affect Orders which we have already confirmed as described above.

 

Delivery

 

We aim to deliver Product(s) to you, to the delivery address you have requested in your Order as soon as possible but we cannot give an exact delivery date.

 

If we have not delivered the Product(s) within 30 days of submitting your Order or any other date that we have agreed with you then you may cancel the Contract and we will refund any money paid by you.

 

Damaged or defective Product(s)

 

You should inspect the Product(s) when you receive them for defects or damage. If you find a defect or damage you must tell us as soon as possible and we will arrange for their return to us. If the Product(s) are found to be damaged prior to delivery to you, or defective (in both cases through no fault of your own (including through your wearing, use or otherwise), we will, at out option, repair or replace the Product(s) or refund the price paid by you, including any delivery charges you paid.

 

OUR LIABILITY TO YOU

 

We exclude all representations, warranties, conditions and terms (whether express or implied by statute, common law or otherwise) to the fullest extent permitted by law.

 

We are only liable to you for losses which you suffer as a result of a breach of these Terms of Sale by us. Our liability for losses you suffer as a result of us breaching these Terms of Sale is strictly limited to the purchase price of the Product you purchased.

To the extent permitted by law, we accept no liability for any indirect or consequential loss or damage incurred by you as a result of a breach of these Terms of Sale by us, including, without limitation any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; or loss of goodwill.

Furthermore, we are not responsible for any delay in, or failure of, performance of our obligations under these Terms of Sale arising from any cause beyond our reasonable control including any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion, failure in information technology or telecommunications services, failure of a third party (including failure to supply data) and industrial action.

Nothing in these Terms of Sale shall exclude or limit our liability for personal injury or death caused by our negligence. In addition, these Terms of Sale shall not limit or exclude any liability for fraud or fraudulent misrepresentation.

Please note that nothing contained in these Terms of Sale in any way affects your statutory rights.  To the extent there is a conflict between your statutory rights and these Terms of Sale, these Terms of Sale will override such statutory rights you may have, unless this is prohibited by law.

 

Your right to cancel

 

If you are a consumer, you have the right, in addition to your other rights, to cancel the Contract (other than for personalised or other products which we have specified as non-returnable) and receive a refund from us. You must inform us by email at jkljewellery@gmail.com if you wish to cancel within seven working days, starting on the day after the Product(s) are delivered by us to you.

 

If you choose to cancel the Contract, then you must return the Product(s), undamaged, to us at your cost and risk and we advise you to ensure the Product(s) are adequately insured during the return journey. You must ensure that you take reasonable care of the Product(s).

 

If you have not returned the Product(s) within 14 days of cancellation or when requested by us to do so, whichever occurs first, we can collect the Product(s) from you at your cost.

 

All refunds will be made within 30 days of our receipt of the Products you have returned to us, provided such Products have not been damaged.

 

Miscellaneous

 

No delay or failure by us to exercise any powers, rights or remedies under these Terms of Sale will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies prevent any other or further exercise of them.

Only you and we shall be entitled to enforce these Terms of Sale. No third party shall be entitled to enforce any of these Terms of Use, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.

These Terms of Sale (including, where applicable, our Terms of Use and Privacy Policy set out the entire agreement between you and us and supersede any and all prior terms of sale, conditions, warranties and/or representations to the fullest extent permitted by law.

If any provision of these Terms of Sale shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

These Terms of Sale shall be governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales. English language prevails.
